01Agreement
These terms are a contract between you and FrontPayUSA, LLC ("FrontPay USA"). They govern your use of frontpayusa.com and any request you submit through it. By using the site you agree to them and to the privacy policy.
02What the service is
FrontPay USA presents your loan request to third-party lenders and returns any offers they make. We are not a lender, broker of record in every state, or your agent, and we do not guarantee that any lender will make an offer, or any particular amount, rate or term. A loan, if any, is a contract solely between you and the lender, governed by that lender's agreement and the law of your state.
03Eligibility and your responsibilities
- You are at least 18, a U.S. resident, and submitting a request for yourself
- Information you provide is true, current and complete, and you will update it if it changes before a loan funds
- You will not use the site for any unlawful purpose, to impersonate anyone, or to interfere with its operation
- You are responsible for anyone who uses your device or account credentials
04Electronic communications and signatures
You consent to receive disclosures, offers and notices electronically at the email address and phone number you provide, and to sign documents electronically. You may withdraw consent by emailing [email protected], which may prevent us from processing a request. Message and data rates may apply to texts; reply STOP to end texts about a request.
05Intellectual property
The site, its text, design, code and trademarks belong to FrontPay USA or its licensors. You may use the site for personal, non-commercial purposes and may not copy, scrape, frame or republish it without written permission. Third-party names, including other companies called FrontPay, belong to their owners.
06Reviews and submissions
By submitting a review or other content you grant FrontPay USA a perpetual, royalty-free licence to publish, edit for length or personal data, and display it, with your first name and last initial. You confirm it is your own experience and that you received nothing for it. Our review policy explains what we publish and remove.
07Disclaimers
The site and its information are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a purpose and non-infringement. Rates and other figures are illustrative and may be out of date. Nothing on the site is legal, tax or financial advice.
08Limitation of liability
To the fullest extent permitted by law, FrontPay USA and its officers, employees and providers are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from a loan made by a third-party lender, your reliance on information on the site, or unauthorized access to your data not caused by our negligence. Our total liability for any claim relating to the site is limited to $100. Some states do not allow these limitations; they apply to the extent permitted.
09Dispute resolution and arbitration
Please read. Any dispute between you and FrontPay USA arising from the site or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, not in court and not as a class action, except that either party may bring an individual claim in small-claims court. You may opt out of arbitration by emailing [email protected] with the subject "Arbitration opt-out" within 30 days of first using the site. This section does not apply to disputes with a lender, which are governed by your loan agreement.
FrontPay USA will pay the AAA filing, administrative and arbitrator fees for any consumer claim under $10,000 unless the arbitrator finds the claim frivolous; each side bears its own legal fees unless the law provides otherwise. The arbitration takes place in the county where you live, by phone or video if you prefer, and the arbitrator may award the same individual relief a court could. You may opt out of this arbitration clause by emailing [email protected] with the subject "Arbitration opt-out" within 30 days of first using the site. These terms and any dispute are governed by the laws of the State of North Carolina and applicable federal law, without regard to conflict-of-law rules; where arbitration does not apply, the state and federal courts in Durham County, North Carolina have exclusive jurisdiction.
10Changes, termination, contact
We may change these terms by posting the new version with a new effective date; continued use after that is acceptance. We may suspend access for misuse.
